Supreme Court will hear consumer complaints against Microsoft and XBox.
The U.S.Supreme Court is allowing the review of a lawsuit against Microsoft and Xbox following user complaints of consoles scratching game disks.
A chance to have their day in court is finally going to happen for the owners, after an initial plea to be heard was dismissed by a federal judge in 2012, according to nbcnews.com. Four years ago the case was dropped, after the Court ruled there was no justification for a class action lawsuit due to the lack of consumer complaints against Xbox.
The case will now go forward due to a federal appeals court reversal of the initial decision. Microsoft Corporation, the parent company of Xbox, maintains it produces a quality product and that with Xbox 360 sales of $80 million, only 4 percent of owners have reported any complaints.
While Microsoft says that product defects stem from users’ misuse of the gaming system, the Supreme Court will determine whether the software corporation’s claims are creditable or whether consumers’ complaints of design defects of the video game console are accurate.
Although individual claims by plaintiffs had been previously thrown out of the Supreme Court, the justices agreed Friday to address the appeal.
